General Terms and Conditions of Use (GTCU)

Preamble

The purpose of these General Terms of Use (hereinafter “GTU”) is to define the conditions of use of the e-commerce site https://www.dotbook.dz (hereinafter “the Site”). They comply with the laws and regulations in force in Algeria. By accessing the Site and using its services, the user (hereinafter “the User”) accepts these GCU without reservation.

1. Legal information

The Site is published by SARL Dotbook Stationery, with a capital of 1 000 000.00DA, registered in the Trade Register under number 23B1282175-16/01, whose registered office is located at 36 Bis Rue Dekkar Rahmoune, El Biar, Algiers, Algeria.

2. Site access

The Site is accessible free of charge to any User with Internet access. All costs relating to access to the Site, whether hardware, software or Internet access, are the sole responsibility of the User.

3. Products & Services

The Site offers stationery products for sale. The essential characteristics of the products and services and their respective prices are made available to the User on the Site. Photographs of products have no contractual value.

4. Controls

The User may place orders on the Site. To place an order, the User must follow the online ordering process and accept these GTC. Validation of the order by the User implies acceptance of the prices and descriptions of the products available for sale.

5. Payment

5.1 Payment for purchases is made either in cash on delivery or by credit card when the order is placed on the Site.

5.2 Transactions are settled by domestic bank cards bearing the “CIB” and/or “EDAHABIA” logos of issuing banks affiliated to the Interbank Electronic Payments Network managed by SATIM.

5.3 Payment by credit card is secured on the SATIM online payment platform, which offers a fully secure payment service.

5.4 The customer guarantees SARL Dotbook Stationery, when validating his order, that he has the following necessary authorizations:

a. Possess a valid “CIB” and/or “EDAHABIA” card;

b. Have signed an online payment contract;

c1. Have a confidential code for internet payments received from your bank with a CIB card.

c2. Have a telephone number linked to your EDAHABIA card to receive the unique password for internet payments sent by ALGERIE POSTE.

5.5 Regardless of whether the payment is “Accepted” or “Rejected” on the online payment platform, the customer is immediately informed by a message displayed on the screen. If the service is not available, the payment is not taken into consideration and the customer must repeat the purchase operation.

5.6 In the case of accepted payments, the customer is obliged to carefully keep the payment receipt displayed at the end of the transaction, as it contains the information required for any request for information or complaint. It is understood that the payment receipt does not in any way represent a legal document.

6. Delivery

Products are delivered to the address indicated by the User when placing the order. Delivery times are indicated on the Site and may vary according to product availability. The Site cannot be held responsible for delays in delivery attributable to transport services.

7. Warranty

Products sold on the Site benefit from the legal guarantee of conformity and the guarantee against hidden defects, allowing the User to return defective or non-compliant products.

8. Liability

The Site declines all responsibility for damage of any kind, whether material, immaterial or physical, which may result from improper use of the products marketed. The Site may not be held liable in the event of non-performance or improper performance of the contract due either to the fault of the User, or to the insurmountable and unforeseeable fault of a third party to the contract, or to a case of force majeure.

9. Personal data

The Site undertakes to protect the User’s personal data in accordance with the regulations in force. The information collected is necessary to manage orders and improve the services offered. Users have the right to access, rectify and delete their personal data.

10. Intellectual Property

All elements of the Site, whether visual or audio, including the underlying technology, are protected by copyright, trademark or patent law. They are the exclusive property of the Site. Total or partial reproduction of these elements is strictly forbidden without prior authorization.

11. Modifications to the GCU

The Site reserves the right to modify these GCU at any time. New versions will be posted on the Site. The User is invited to consult the GCU on a regular basis.

12. Applicable Law and Jurisdiction

These GCU are governed by Algerian law. In the event of a dispute, and after attempting to find an amicable solution, jurisdiction is assigned to the competent Algerian courts.
